These Terms of Service (the "Terms") govern your access to and use of minimax-h3.run and its AI video and image generation tools (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

MiniMax H3 is an independent service and is not affiliated with, endorsed by, or sponsored by MiniMax or its affiliates. Third-party product and model names belong to their respective owners.

1. Eligibility and Authority

You must be at least 13 years old, meet the minimum digital-consent age in your location, and be legally capable of entering into these Terms. If you are under the age of legal majority, a parent or guardian must approve your use. If you use the Services for an organization, you represent that you have authority to bind that organization, and "you" includes the organization.

2. Accounts

You must provide accurate information and keep it current. You are responsible for safeguarding your sign-in credentials and for activity under your account. Do not share verification codes or allow unauthorized access. Notify us promptly at [email protected] if you suspect that your account has been compromised.

We may refuse registration, require verification, reclaim usernames, or limit accounts where reasonably necessary to protect the Services or comply with law.

3. The Services

MiniMax H3 provides tools for generating and editing video, images, audio-enabled media, and related creative content from prompts and reference materials. Features, supported models, output specifications, generation times, and availability may change. Some features may be experimental, limited by quota, or provided by third parties.

AI generation is probabilistic. We do not guarantee that outputs will be accurate, unique, uninterrupted, error-free, suitable for a particular purpose, or available for any specific period. You must review outputs before relying on, publishing, or distributing them.

4. Subscriptions, Credits, and Payments

Some features require a paid plan or credits. Prices, included credits, renewal periods, usage limits, taxes, and other material billing terms are shown at purchase. By completing a purchase, you authorize us and our payment provider to charge the selected payment method.

Subscriptions renew automatically for the period shown at checkout unless canceled before the renewal date. Cancellation stops future renewal and does not ordinarily reverse charges already incurred. Credits may expire, may be limited to particular features, and have no cash value except where required by law. Failed generations and provider errors are handled according to the credit rules presented in the Services.

Except where required by law or expressly stated at purchase, payments are non-refundable. Contact [email protected] with billing questions. Any statutory cancellation or refund rights remain unaffected.

5. Your Content

"User Content" means prompts, images, video, audio, files, feedback, and other material you submit, as well as outputs generated for you through the Services.

As between you and MiniMax H3, you retain your rights in content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, modify, display, and otherwise process User Content only as reasonably necessary to operate, secure, support, and improve the Services; comply with law; and enforce these Terms. This license includes allowing our service and model providers to process User Content for those purposes.

You represent that you have all rights, permissions, and lawful bases needed to submit User Content and permit its processing. You are responsible for User Content and for how you use or distribute generated outputs, including obtaining permissions for identifiable people, copyrighted works, trademarks, voices, music, and personal information.

6. AI Outputs and Rights

Subject to these Terms and applicable law, you may use outputs generated for you. Laws regarding ownership and copyright protection of AI-generated material vary, and we do not promise that any output is eligible for intellectual property protection or free from third-party claims.

Outputs may be inaccurate, unexpected, or similar to content generated for other users. You must perform appropriate legal, factual, and quality review before commercial use or publication. We do not provide legal clearance for an output.

7. Acceptable Use

You may not use the Services to:

violate any law, regulation, court order, or third-party right;
create, upload, or distribute child sexual abuse material or sexual content involving minors;
exploit, threaten, harass, defame, deceive, or facilitate violence against a person or protected group;
create non-consensual intimate content, sexualized depictions of real people, or deceptive impersonations intended to cause harm;
infringe intellectual property, privacy, publicity, confidentiality, or data protection rights;
generate fraud, phishing, malware, spam, disinformation intended to cause material harm, or instructions for wrongdoing;
bypass safety filters, access controls, rate limits, payment controls, or usage restrictions;
probe, disrupt, overload, scrape, reverse engineer, or interfere with the Services except where a restriction is prohibited by law;
resell access, transfer accounts, or use automated means to extract data or outputs at unreasonable scale without written permission.

We may investigate suspected violations and remove content, restrict generation, suspend access, preserve evidence, or report conduct to authorities where appropriate.

8. Our Intellectual Property

The Services, including our software, interface, design, documentation, and original branding, are owned by us or our licensors and are protected by applicable laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

"MiniMax," model names, and related marks may be trademarks of third parties. Your use of the Services does not grant you rights to those marks or imply that your content is approved by any model provider.

9. Third-Party Services

The Services may rely on third-party AI models, hosting providers, identity services, payment processors, or links. Third-party services may be subject to separate terms and policies. We are not responsible for third-party services, and their availability or behavior may affect the Services.

10. Feedback

If you submit ideas, suggestions, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation. This does not transfer ownership of unrelated User Content.

11. Privacy

Our Privacy Policy explains how we collect, use, and disclose information. By using the Services, you acknowledge those practices.

12. Suspension and Termination

You may stop using the Services at any time. We may suspend or terminate access, remove content, or limit features if we reasonably believe you violated these Terms, created risk or legal exposure, failed to pay amounts due, or used the Services in a way that could harm users, providers, or the Services.

We may also discontinue all or part of the Services. Where reasonably practicable, we will provide notice. Sections that by their nature should survive termination will survive, including payment obligations, licenses already required for prior operation, intellectual property provisions, disclaimers, liability limits, indemnity, and dispute terms.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.

We do not warrant that generated content is lawful, unique, accurate, non-infringing, or appropriate for your intended use. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINIMAX H3 AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR CONTENT, ARISING FROM OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.

These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.

15. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless MiniMax H3 and its service providers from claims, damages, losses, liabilities, and reasonable expenses arising from your User Content, your use of outputs, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.

16. Disputes and Applicable Law

These Terms are governed by the laws applicable where the operator of MiniMax H3 is established, without regard to conflict-of-law rules, except that mandatory consumer protections in your place of residence continue to apply. Courts with jurisdiction under applicable law may hear disputes. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days, unless immediate relief is legally necessary.

17. Changes to These Terms

We may update these Terms to reflect changes in the Services, third-party requirements, or law. We will post the revised Terms and update the "Last Updated" date. If a change materially reduces your rights, we will provide additional notice where required. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.

18. General Terms

If a provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Services. These Terms and policies incorporated by reference are the entire agreement between you and us regarding the Services.
